SociaSpark Digital ("SociaSpark", "we", "us", "our") is a digital marketing agency registered and operating in India, with offices in Mumbai, Pune, and Jaipur. We provide digital marketing, social media, advertising, SEO, web design, and related services to businesses and individuals.
Our services include, but are not limited to, social media marketing, LinkedIn management, website design and development, PPC advertising, search engine optimisation (SEO), and content and email marketing. The specific scope, deliverables, timelines, and fees for each engagement are defined in a separate Service Agreement or Statement of Work signed by both parties.

Upon receipt of full payment, you own the final deliverables created specifically for your brand. SociaSpark retains ownership of all underlying tools, frameworks, methodologies, templates, and generic components used to create those deliverables.
You grant SociaSpark a non-exclusive licence to use your brand name, logo, and campaign results for portfolio and case study purposes, unless explicitly restricted in writing.
Both parties agree to keep confidential all proprietary information shared during the engagement. This includes business strategies, financial information, campaign data, and client lists. This obligation survives termination of the agreement for a period of 2 years.
While SociaSpark strives to deliver measurable results, we cannot guarantee specific outcomes such as follower counts, search engine rankings, leads, or revenue. Digital marketing results depend on many factors beyond our control, including platform algorithm changes, market conditions, and budget constraints. Our performance targets are projections based on available data and industry benchmarks.
To the maximum extent permitted by applicable law, SociaSpark's total liability to you for any claim arising from or related to our services shall not exceed the total fees paid by you in the three months preceding the claim. We shall not be liable for any indirect, consequential, incidental, or punitive damages, including loss of profits or business opportunities.
Either party may terminate the service engagement with 30 days' written notice unless otherwise stated in the Service Agreement. Upon termination:
These Terms and Conditions are governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.
SociaSpark reserves the right to update these Terms and Conditions at any time. Material changes will be communicated via email or posted on our website. Continued use of our services after such changes constitutes acceptance of the revised terms.
